Frequently Asked Questions
Can anyone get a No-Fault Divorce? NO. One party must be a resident of Pennsylvania for 6 months in order for us to handle your case. This process is best when both Wife and Husband will cooperate and sign forms.
What if my spouse will not sign divorce papers? You must be separated for more than 2 years in order to do a Pennsylvania Divorce without your spouses signature. If your spouse can be served and he/she does not respond, you may be able to get your divorce without signature. Even after 2 years, your spouse could contest the case. No divorce is automatic.
When is a No-Fault Divorce NOT appropriate? In general, if there are property or economic issues that can NOT be resolved, a No-Fault Pennsylvania Divorce is NOT appropriate. A marital home or pension can sometimes complicate a divorce. You must contact an attorney to discuss these issues before deciding on a No-Fault Pennsylvania Divorce.
How long does a No-Fault Pennsylvania Divorce take? Your separation length will help determine the divorce length. Pennsylvania No-Fault Divorces are filed as more than 2 year separation or less than 2 year separation cases. For greater than 2 year separation cases, the Pennsylvania Divorce generally takes between 2.5-3 months. If you do not have at least 2 years of separation, the case generally takes around 4-5 months.
Will I get a final divorce paper? Yes. The plaintiff always receives a certified final divorce decree upon completion of the Pennsylvania Divorce. The defendant will receive a photocopy of the final divorce decree, but could pay a small extra fee to also receive a certified divorce decree. You should save your final divorce decree for future reference and it will be required if you get married again.

Chapter 7 Bankruptcy
A Chapter 7 Bankruptcy provides you a fresh start by wiping out or “discharging” your allowable debts. Whether you should file a Chapter 7 bankruptcy will depend upon your circumstances. Your attorney will want to examine your debts, your assets, and your income, among other things, before you file. A Trustee is appointed to take over your “non-exempt” property for the creditors, but most Chapter 7 debtors can keep most of their important property under the bankruptcy laws. Bankruptcy is NOT right for every situation and your specific case will depend on your own circumstances. In October 2005, a new bankruptcy law went into effect which makes it more involved to file bankruptcy. There is a “means test” which a debtor must pass to determine if he/she qualifies for Chapter 7 bankruptcy or if they must pay back a portion of their debt. There are many other requirements too.
Chapter 13 Bankruptcy
This type of bankruptcy allows you to repay your debts over time in a “Plan” and usually keep your property. Most commonly, debtors will file this type of bankruptcy to stop a foreclosure proceeding and repay mortgage arrearages. The Court will examine your budget and must approve your “Plan”. The new bankruptcy law requires some debtors to file Chapter 13 to repay their debts rather than Chapter 7, if there income is over a certain median level.
As required by the new bankruptcy law, Reinherz and Reinherz (David Reinherz, Esquire) is a "Debt Relief Agency" who helps people file for bankruptcy relief under the Bankruptcy Code.
